ACT 7 OF I960

THE KERALA WEIGHTS AND MEASURES (ENFORCE­MENT)AMENDMENT ACT, 1960 [1]

      An Act to amend the Kerala Weights and Measures (Enforce­ment) Act, 1958.

          Preamble. — whereas it is deemed necessary to amend the Kerala Weights and Measures (Enforcement) Act, 1958, for the purpose hereinafter appearing;

                  be it enacted in the Eleventh Year of the Republic of India as follows: —

        1. Short title and commencement. — (I) This Act may be called the Kerala Weights and Measures (Enforcement) Amend­ ment Act, 1960.

                 (2) It shall come into force at once.

        2. Insertion of new section 40A. — After section 40 of the Kerala Weights and Measures (Enforcement) Act, 1958 (Act 45 of 1958), the following section shall be inserted, namely: —

                  "40A. Power of Government to exempt—The Government may, by notification in the Gazette, exempt, subject to such conditions, and restrictions as they may think fit to impose,—

                      (i)  any class of persons ;

                      (ii)  any commodity ;

                      (iii)  any trade or class of trades; or

                      (iv) any class of weights, measures, or weighing or measuring instruments used or
intended to be used for any purpose other than any trade or trades specified in the notification,

                    from all or any of the provisions of this Act, if the Govern­ment are satisfied that it is necessary so to do in the public I nterest".
